LinkAfrik is an online recruitment platform whose mission is to connect companies and candidates across Africa, starting with Morocco. We provide free tools enabling candidates to create their profile and resume, apply for jobs, and companies to post job listings and freelance projects.

This Privacy Policy describes how LinkAfrik collects, uses, stores, and protects the personal data of users of the platform accessible at linkafrik.com. It applies to all users, whether candidates, companies, or website visitors.

The processing of personal data by LinkAfrik is governed by Moroccan Law No. 09-08 on the protection of individuals with regard to the processing of personal data and its implementing decree No. 2-09-165. We recognize the authority of the National Commission for the Control of Personal Data Protection (CNDP) as the competent supervisory authority.

By creating an account or using our services, you acknowledge that you have read this policy and consent to the processing of your data as described below. We encourage you to read this document carefully before providing us with any personal information.

3. Data Collected

LinkAfrik collects different categories of personal data depending on your use of the platform. Below is a detailed description of the data we may process:

3.1 Registration Data

When creating your account, we collect the following information: last name, first name, email address, password (stored as a cryptographic hash, never in plain text), and your role on the platform (candidate or company). This data is essential for creating and managing your account.

3.2 Candidate Profile Data

Candidates can enrich their profile by adding professional information: complete resume, work experience, academic qualifications, technical and interpersonal skills, phone number, and a profile photo (optional). This data aims to maximize your chances of being matched with relevant job opportunities.

3.3 Company Data

Companies can provide information about their organization: company name, business description, industry sector, company size, city or region of operation, company logo (optional), and official website URL. This information helps candidates learn more about the organizations recruiting them.

3.4 Application Data

When a candidate applies for a job posting, we collect the data submitted as part of that application: the attached or shared resume, the cover letter (if applicable), and the application status history (pending, viewed, rejected, accepted).

3.5 Freelance Project Data

When a company publishes a freelance project, we collect information related to that project: title, detailed description, estimated budget or budget range, and skills required for project completion.

3.6 Technical Data

While browsing the platform, we automatically collect certain technical data for security and service improvement purposes: IP address, browser type and version, operating system, pages visited, access dates and times, and actions performed on the platform. This data is collected automatically through our hosting servers.

3.7 Cookies

We use cookies strictly necessary for the operation of the platform, including authentication session cookies that maintain your active connection, and preference cookies that record your display choices (light or dark theme, language preferences). No advertising or third-party tracking cookies are placed on your device.

4. Legal Basis for Processing

In accordance with Law No. 09-08, all processing of personal data must be based on a legal basis. LinkAfrik bases its processing on the following legal grounds:

  • Contract performance: registration, profile, application, and freelance project data are processed to provide the services you subscribed to when creating your account. Without this data, we would not be able to fulfill our contractual obligations to you.
  • Consent: certain optional data, such as the profile photo, is processed based on your explicit consent. You may withdraw this consent at any time without affecting the lawfulness of processing carried out before such withdrawal.
  • Legitimate interest: technical data and access logs are processed based on our legitimate interest in ensuring platform security, preventing fraud, improving our services, and producing anonymized usage statistics.
  • Legal obligation: certain data may be retained or disclosed to competent authorities when required by Moroccan law or a court order.

LinkAfrik commits to processing your personal data only for the purposes for which it was collected, and not to reuse it for purposes incompatible with those originally stated, in accordance with Article 3 of Law No. 09-08.

5. Use of Data

The personal data we collect is used exclusively for the following purposes:

  • Provide and maintain our services: account creation and management, platform access, profile updates, posting job listings or projects, and managing applications.
  • Connect candidates and companies: enable companies to view the profiles and resumes of candidates who have applied, and enable candidates to discover job opportunities suited to their profile.
  • Manage applications and freelance proposals: forward applications to relevant companies, update application statuses, and facilitate communication between parties within the platform.
  • Send account-related notifications: notify you of new applications received, status updates, and important messages related to your account or the platform.
  • Improve and personalize your experience: analyze browsing behavior in aggregate to improve the interface, features, and relevance of displayed results.
  • Ensure security and prevent fraud: detect suspicious behavior, protect accounts from unauthorized access, and ensure platform integrity.
  • Comply with our legal obligations: retain certain data within legally prescribed timeframes, respond to requests from competent authorities, and comply with court orders.
  • Produce anonymized statistics: generate aggregated and anonymous reports on platform usage for service improvement purposes, without enabling individual identification.

LinkAfrik does not use your personal data for targeted advertising, commercial profiling, or fully automated decision-making that could produce significant legal effects concerning you.

6. Data Sharing

LinkAfrik places great importance on respecting your privacy and commits to sharing your personal data only with parties strictly necessary for providing its services, under the conditions described below.

  • Companies using the platform: when a candidate applies for a job posting or freelance project, their resume, cover letter, and professional profile information are shared with the company that posted the listing. This sharing occurs only at the candidate's initiative, who has previously consented to this transmission by submitting their application.
  • Technical service providers: we use technical subcontractors for platform hosting (Vercel, Inc.) and sending email notifications. These providers act as processors and are only authorized to process your data for the purposes assigned to them, under contractual obligations of confidentiality and security.
  • No data sales: LinkAfrik never sells, rents, or transfers your personal data to third parties for commercial or advertising purposes, regardless of the nature of such data.
  • No targeted advertising: LinkAfrik does not share your data with advertising networks or targeted advertising platforms. We do not engage in behavioral advertising.
  • Competent authorities: LinkAfrik may be required to disclose certain data to Moroccan judicial, administrative, or regulatory authorities when required by law or in response to a validly rendered court decision.

Any transfer of data to third parties is governed by contractual agreements ensuring a level of protection equivalent to that which we provide for your data on our own infrastructure.

7. International Data Transfers

LinkAfrik's technical infrastructure is hosted by Vercel, Inc., a company whose servers are primarily located in the United States of America. Consequently, your personal data may be transferred and stored outside the Kingdom of Morocco, in a country that does not necessarily provide a level of data protection equivalent to that guaranteed by Moroccan Law No. 09-08.

In accordance with Articles 43 and following of Law No. 09-08, any transfer of personal data to a foreign state not providing adequate protection must be governed by appropriate safeguards. To address this situation, LinkAfrik relies on the following measures:

  • Binding contractual clauses with Vercel, Inc. imposing security and confidentiality obligations on hosted data;
  • Encryption in transit and at rest for sensitive data;
  • Strict limitation of data access to authorized personnel only at the service provider.

LinkAfrik has notified or commits to notifying the CNDP of any transfer of personal data to third-party states, in accordance with the reporting obligations provided by Law No. 09-08. By creating an account on the platform, you are informed and accept that your data may be subject to this international transfer under the protection conditions described above.

8. Data Retention

LinkAfrik retains your personal data only for the duration necessary for the purposes for which it was collected, within the limits set by law. The applicable retention periods are as follows:

  • Active account: all data related to your account is retained for the entire duration of your account's activity, as long as you do not request its deletion.
  • Deleted account: upon deletion of your account, your personal data is permanently erased within a maximum period of thirty (30) days.
  • Technical data: browsing data and connection logs are retained for a maximum period of twelve (12) months.
  • Application data: retained for a maximum period of twenty-four (24) months from the last associated activity.
  • Legal obligations: certain data may be retained beyond the above timeframes when required by a legal obligation.

Upon expiration of retention periods, your data is either securely deleted or irreversibly anonymized.

9. Data Security

LinkAfrik takes the security of your personal data very seriously and implements appropriate technical and organizational measures to protect it.

  • Password encryption: robust cryptographic hashing (bcrypt or equivalent).
  • Communication encryption: HTTPS/TLS protocol for all communications.
  • Access control: access strictly limited to authorized personnel.
  • Security audits: regular reviews of our code and infrastructure.
  • Secure hosting: Vercel infrastructure with recognized security certifications.

In the event of a data breach, LinkAfrik commits to notifying the competent authorities and affected individuals within the timeframes provided by applicable regulations.

10. Your Rights

In accordance with Moroccan Law No. 09-08, you have the following rights:

  • Right of access: obtain a copy of your personal data.
  • Right of rectification: request the correction of inaccurate data.
  • Right of opposition: object to processing for legitimate reasons.
  • Right of deletion: request the erasure of your data.
  • Right to portability: receive your data in a structured and readable format.

11. Protection of Minors

The platform is intended for persons aged 16 and over. We do not knowingly collect data from minors. Contact us if you believe a minor has created an account.

13. Policy Changes

LinkAfrik may modify this policy at any time. Substantial changes will be notified by email. Your continued use of the platform constitutes acceptance of the revised policy.
